Halle Berry Loses Bid for 50/50 Custody as Judge Sides With Olivier Martinez — For Now
A judge kept Berry's ex with primary physical custody of their son Thursday, though her domestic violence restraining order was dissolved and a fresh hearing is set for November.
A judge ruled Thursday that Olivier Martinez will keep primary physical custody of his and Halle Berry's 13-year-old son, Maceo, rejecting Berry's request for a 50/50 arrangement and curbing her overnight visits, according to Martinez's attorney. Berry did retain joint legal custody, giving her tiebreaker authority on major decisions, and she succeeded in getting a domestic violence restraining order against her dissolved during the same hearing. The dispute began after Martinez alleged Berry had choked their son, a claim she has denied; Berry has separately accused Martinez of refusing to "co-parent" in a child-centered way. A follow-up hearing is scheduled for November.
